Welcome to Tinson Design. The terms “we,” “us,” and “our” refer to Tinson Design. We operate this website and store—along with all related information, content, features, tools, products, and services—to provide you with our shopping experience (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service (the “Terms”), together with any policies referenced here, explain your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, browsing, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

We do not guarantee that the look, appearance, or quality of any product or service will meet your expectations or match what you see on your screen.

Product descriptions may be updated or changed at any time without notice at our sole discretion. We may discontinue any product at any time. We may also limit quantities offered to any person, region, or jurisdiction on a case-by-case basis.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Tinson Design may accept or decline any order in our discretion. An order is not accepted until we confirm acceptance, and we must receive and process payment before acceptance.

Review your order carefully before submitting. After acceptance, we may not be able to accommodate cancellation requests. If we decline, change, or cancel an order, we will attempt to notify you using the contact details you provided (such as email, billing address, and/or phone number).

Purchases are eligible for return or exchange only as set out in our Refund Policy.

You represent and warrant that purchases are for personal or household use, and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect when you place the order and will appear in your order confirmation.

Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, customs duties, or import charges.

Prices on our website may differ from prices in physical stores or on third-party sites. From time to time, we may run promotions governed by separate terms. If promotional terms conflict with these Terms, the promotional terms control.

You agree to provide and maintain accurate, current, and complete purchase, payment, and account information. You agree to promptly update details (including email address and payment card information) so we can process transactions and contact you when needed.

You represent and warrant that:

the payment card information you provide is true, correct, and complete;
you are authorized to use the card;
charges will be honored by your card issuer; and
you will pay all charges at the posted prices, including shipping/handling and applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

We are not responsible for shipping or delivery delays. Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or circumstances outside our control.

Once we hand products to the carrier, title and risk of loss transfer to you.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their content—including trademarks, branding, text, displays, images, graphics, product reviews, video, audio, and the overall design, selection, and arrangement—are owned by Tinson Design and/or our affiliates or licensors, and are protected by U.S. and international intellectual property laws.

These Terms grant you a limited right to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any Service materials without our prior written consent.

Except as expressly stated in these Terms, nothing grants you any license or rights under any patent, trademark, copyright, or other intellectual property of Tinson Design, Shopify, or any third party. Unauthorized use may violate applicable laws. All rights not expressly granted are reserved.

“Tinson Design” names, logos, product/service names, designs, and slogans are trademarks of Tinson Design or our affiliates/licensors and may not be used without written permission. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or services offered by third parties. We do not control, monitor, or endorse them.

You agree that third-party tools are provided “as is” and “as available,” without warranties or conditions of any kind. We are not liable for issues arising from your use of optional third-party tools.

Any use of optional tools is at your own risk, and you should review the relevant third party’s terms before using them.

We may introduce new features or tools in the future. These will also form part of the Services and be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may include links or embedded functionality from third parties. We are not responsible for evaluating the content, accuracy, or practices of third-party websites or materials.

If you choose to access third-party sites, you do so at your own risk. We are not liable for harm or damages related to third-party sites, or your purchase or use of third-party products/services/content.

Review the third party’s policies carefully. Issues related to third-party products/services should be addressed directly with the third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Tinson Design.

You acknowledge that Shopify is not responsible for any aspect of sales between you and Tinson Design, including any injury, damage, or loss related to products or services purchased. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to transactions with Tinson Design.

SECTION 10 — PRIVACY POLICY

Personal information collected through the Services is handled under our Privacy Policy. Certain information may also be subject to Shopify’s Privacy Policy.

Because the Services are hosted on Shopify, Shopify may collect and process information about how you access and use the Services to operate and improve them. Information you submit may be transmitted to Shopify and to service providers in other countries to provide the Services.

You represent and warrant that:

you own or have the necessary rights to submit the Feedback;
you have disclosed any compensation/incentives related to the Feedback; and
your Feedback complies with these Terms.

We are not obligated to keep Feedback confidential, pay compensation, or respond. We may (but are not required to) monitor, edit, or remove Feedback we determine is unlawful, offensive, threatening, defamatory, obscene, otherwise objectionable, or violates intellectual property or these Terms.

You agree your Feedback will not infringe third-party rights, include unlawful or abusive material, or contain malware. You may not misrepresent identity or origin. You are solely responsible for your Feedback and its accuracy.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may occasionally contain errors, inaccuracies, or omissions (including product descriptions, pricing, promotions, offers, shipping charges, transit times, availability). We may correct such issues and update information, or cancel orders if information is inaccurate, at any time without prior notice (including after an order is submitted).

Content on the Services is provided for general information only. We do not warrant accuracy, completeness, or usefulness. Any reliance is at your own risk. We disclaim liability arising from reliance by you or others.

EXCEPT AS EXPRESSLY STATED BY TINSON DESIGN, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 16 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TINSON DESIGN, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS (OR SHOPIFY AND ITS AFFILIATES) BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

SECTION 17 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tinson Design, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, or claims (including reasonable attorneys’ fees) arising from:

your breach of these Terms or incorporated documents;
your violation of law or third-party rights; or
your access to or use of the Services.

We will notify you of indemnifiable claims, though delayed notice will not relieve your obligations unless it materially prejudices you. We may control the defense and settlement at your expense (including counsel selection), but will not settle claims imposing non-monetary obligations on you without your consent (not unreasonably withheld). You will cooperate as reasonably required.

SECTION 18 — SEVERABILITY

If any provision is found unlawful, void, or unenforceable, it will be enforced to the maximum extent allowed, and the unenforceable portion will be severed without affecting the remaining provisions.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

Failure to enforce any right or provision is not a waiver of that right or provision.

These Terms, along with posted policies and rules, form the entire agreement between you and us regarding the Services, replacing prior agreements and communications. Any ambiguity will not be interpreted against the drafting party.

SECTION 20 — ASSIGNMENT

You may not assign, transfer, or delegate these Terms (or any rights/obligations) without our prior written consent; any attempted assignment is void. We may assign or transfer these Terms and our rights/obligations without notice or consent.

SECTION 21 — GOVERNING LAW

These Terms and any separate agreements providing Services will be governed by and construed in accordance with the jurisdiction where Tinson Design is headquartered. You and Tinson Design consent to venue and personal jurisdiction in those courts.

Headings are for convenience only and do not affect interpretation.

SECTION 23 — CHANGES TO TERMS OF SERVICE

The most current version of these Terms will be posted on this page. We may update or replace any part of these Terms by posting changes to our website.

It is your responsibility to review the Terms periodically. Where required by law, we will provide notice of material changes, and such changes will take effect on the date stated in the notice. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
